Terms of Engagement

1. About us
Party Wall Hub, of The Office, Cherry Orchard Barn, Cherry Orchard, Highworth, Swindon SN6 7AU, is a specialist party wall surveying practice and a Member of The Faculty of Party Wall Surveyors (FPWS) and the Residential Property Surveyors Association (RPSA).
2. Our services
We provide services under the Party Wall etc. Act 1996, including drafting and serving notices, preparing Schedules of Condition, drafting and serving Party Wall Awards, and representing adjoining owners. The specific scope of each instruction is set out in your quotation.
3. Fees
Fees are fixed and set out in your quotation. Where you are the building owner you are also responsible for the adjoining owner's reasonable surveyor's fees as required by the Act. Disbursements (e.g. Land Registry searches) are charged at cost.
4. Payment
Invoices are payable within 14 days of issue unless otherwise agreed in writing. We reserve the right to pause work on overdue accounts.
5. Your obligations
You agree to provide accurate information, drawings and access in good time, and to notify us promptly of any changes to the proposed works or your contact details.
6. Cancellation
You may cancel at any time. Where work has already been carried out, fees for that work remain payable. Consumer rights under the Consumer Contracts Regulations 2013 are not affected.
7. Limitation of liability
Our liability for any single claim is limited to the level of our professional indemnity insurance (£1,000,000) and £2,000,000 public liability insurance. Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.
8. Complaints
If you are unhappy with our service, please email info@partywallhub.co.uk. We will acknowledge your complaint within 5 working days and aim to provide a full response within 28 days. If not resolved, complaints can be referred to the FPWS complaints procedure.
9. Data protection
We process personal data in accordance with our Privacy Policy and UK GDPR.
10. Governing law
These terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
