Homeowners in Trowbridge face a specific set of challenges when planning extensions or renovations. Whether you occupy a three-storey weaver’s cottage in the Trowbridge Conservation Area or a modern detached home in Hilperton, the Party Wall etc. Act 1996 is a legal requirement that cannot be overlooked. As FPWS and RPSA-registered surveyors based in Highworth, Party Wall Hub provides specialist advice across the BA14 postcode, ensuring your project remains compliant while protecting the structural integrity of your property.
Under the Party Wall etc. Act 1996, you are legally obliged to notify your neighbours if you intend to carry out specific types of work. This includes building on the boundary line (Section 1), working directly on a shared wall (Section 2), or excavating within three or six metres of a neighbouring structure (Section 6). In Trowbridge, the dense Victorian housing stock and the rapid expansion of new estates in Staverton and Southwick mean that almost every extension or loft conversion will trigger one or more of these sections.
Victorian Terraces and Rubble Foundations
Our free 60-second eligibility checker tells you which sections of the Act apply to your Trowbridge project and the exact fixed fee — no obligation.
Trowbridge is defined by its industrial heritage, particularly the dense rows of Victorian weaver's terraces. These properties are often three storeys high and were frequently built with shallow rubble foundations. This creates a significant risk profile for any modern construction work. If you are planning a rear extension or a loft conversion in the town centre, the vibration from demolition or the pressure from new foundations can easily cause settlement or cracking in the adjoining property.
Under Section 2 of the Act, you must provide two months' notice for work to a party wall, such as cutting in to insert steel beams for a loft conversion. However, it is Section 6—excavation within three metres—that poses the greatest risk to older Trowbridge stock. Because these terrace foundations are rarely deep, new trenches for an extension can undermine the neighbouring cottage. At Party Wall Hub, we prioritise a thorough photographic Schedule of Condition before any groundwork begins. This document provides a clear record of the neighbour's property state, protecting the building owner against fraudulent damage claims and ensuring the adjoining owner has evidence if genuine damage occurs. A standalone Schedule of Condition is priced at £350, though it is included for free as part of a full Party Wall Award.
Boundary Issues in Hilperton, Staverton, and Studley Green
It is not just the older properties in the Trowbridge Conservation Area that require a surveyor. The newer estates in Hilperton, Staverton, and Studley Green present different but equally complex issues. Modern developers often build right up to the boundary line to maximise space. When a homeowner later decides to add a conservatory, orangery, or wrap-around extension, they often find that their new foundations will sit within the three-metre zone of the neighbour’s house or garage.
Under Section 6, you must serve notice one month before starting excavations. Many homeowners mistakenly believe that if they are building on their own land, the Act does not apply. This is incorrect. If your new foundations are deeper than the neighbour’s foundations and within three metres, the Act is invoked. Failing to serve notice is a breach of statutory duty and can lead to a court injunction, halting your build and significantly increasing your costs.
Understanding the 14-Day Response Window
Once a notice is served, the adjoining owner has 14 days to respond. There are three primary routes they can take:
- Consent: The neighbour agrees to the work in writing. The project can proceed, though we still recommend a Schedule of Condition to protect both parties.
- Dissent and Appoint an Agreed Surveyor: Both parties agree to use one surveyor to act impartially. At Party Wall Hub, our fee for an Agreed Surveyor is £650. This is the most cost-effective way to resolve a dispute.
- Dissent and Appoint Separate Surveyors: The neighbour appoints their own surveyor. The building owner is responsible for paying both surveyors' fees. Our fee for acting as the building owner's surveyor in this scenario is £850.
If the neighbour does not respond within 14 days, a 'deemed dispute' arises. You cannot simply assume silence means consent. In this case, a surveyor must be appointed on their behalf to move the process forward legally.
Wiltshire Council Planning and Local Expertise
Navigating the requirements of the Wiltshire Council planning department is only the first step. While planning permission deals with the aesthetics and usage of the land, the Party Wall etc. Act 1996 deals with the structural rights and responsibilities between neighbours. Our office in Highworth is approximately a 50-minute drive from Trowbridge, allowing us to conduct site visits and inspections across Southwick, Hilperton, and the town centre with ease.
We operate with a transparent, fixed-fee structure to ensure homeowners can budget accurately for their build. We do not use hidden charges or hourly rates for standard residential projects.
Our fixed fees for Trowbridge and the BA14 area: - First notice: £50 - Each additional notice on the same project: £30 - Agreed Surveyor: £650 - Building owner's appointed surveyor (Full Award): £850 - Standalone Schedule of Condition: £350 (Free when included with an Award)
In the vast majority of cases, the building owner pays the adjoining owner's reasonable surveyor fees. This means that if you have received a notice from a neighbour, it usually costs you £0 to have professional representation to ensure your property is protected.
