The Notice Process and Timelines

Once a notice is served, the adjoining owner has 14 days to respond. There are three possible outcomes:

  1. Dissent and Appoint an Agreed Surveyor: The neighbour dissents to the notice but agrees to use one surveyor (the Agreed Surveyor) to act impartially for both sides. This is the most cost-effective way to resolve a dispute.
  1. Dissent and Appoint Separate Surveyors: The neighbour appoints their own surveyor, and the two surveyors work together to agree on a Party Wall Award.

If the neighbour does not respond within 14 days, they are in 'deemed dispute'. You cannot ignore this and start work; you must follow the dispute resolution process outlined in the Act, which involves appointing a surveyor to act on their behalf.
